PRIVACY POLICY

This Policy describes the privacy practices of Tanner Fletcher LLC (“Tanner Fletcher,” “we,” “us,” or “our”) for tannerfletcherstudios.com and any related pages, services, or features that link to this Policy (collectively, the “Site”). It is provided for your information and does not create a contract; the terms governing your use of the Site are set out separately in our Terms of Use. For California residents, this document also serves as our Notice at Collection.
Our Site is hosted on Shopify and is operated from the United States. We offer our products to customers in the United States, and this Policy describes the rights available to you under United States federal and state privacy laws, including, where applicable, the laws of California, Colorado, Connecticut, and Virginia.
1. Information We Collect
We collect information in three ways: information you provide to us, information we collect automatically, and information we receive from third parties.
Information you provide to us

Contact and order information, such as your name, billing and shipping address, email address, and phone number.

Payment information. Payments are processed by our payment providers, including Shopify Payments and Shop Pay and third-party providers such as Affirm and Klarna (buy now, pay later). We do not store full payment card numbers. We may retain the last four digits of your card, the expiration date, your billing address, and transaction records to process orders, refunds, and chargebacks.

Account information, if you create an account, including login credentials, order history, saved items, and wishlist contents.

Appointment information, if you book an appointment through our booking tool, handled through Sesami.

Communications, such as customer-service inquiries, returns or exchange requests, and survey or marketing responses.

Marketing preferences, including your consent to receive email or SMS marketing.
Information we collect automatically

Device and connection data, such as IP address, browser type, operating system, and device identifiers.

Usage data, such as pages and products viewed, links clicked, referring pages, and dates and times of access.

Information we receive from third parties
We may receive information about you from service providers, advertising and analytics partners, social media platforms, and payment providers, and we may combine it with information we already have.
2. Cookies, Pixels, and Tracking Technologies
We and our partners use cookies, pixels, tags, and similar technologies to operate the Site, remember your preferences, analyze traffic, and deliver and measure advertising. The Site currently uses:

Meta Pixel (Facebook and Instagram) for advertising, retargeting, and conversion measurement;

Google and YouTube for analytics and advertising;

Pinterest for advertising and conversion measurement;

Klaviyo for email and SMS marketing, including tracking of email and on-site activity; and

Wishlist Plus for wishlist functionality.

Several of these technologies share information with third-party advertising platforms for cross-context behavioral advertising. We use Shopify’s automated cookie consent tool to obtain and manage your cookie choices.
3. How We Use Your Information
We use the information we collect to:

Process, fulfill, and ship your orders, and manage returns, exchanges, and appointments;

Operate, maintain, secure, and improve the Site;

Send transactional messages such as order confirmations and shipping updates;

4. How We Disclose Your Information
We disclose personal information in the following circumstances:

Service providers and apps that operate the Site and our business, each receiving only the information needed to perform its function, currently including Klaviyo (email and SMS marketing and customer engagement); Loop Returns (returns and exchange processing); Sesami (appointment scheduling); Instafeed (social media content display); Wishlist Plus (wishlist and saved-item functionality); and Flaunt AI (personalized styling and product recommendations);

Payment providers, including Shopify Payments, Shop Pay, Affirm, and Klarna. We ship orders directly from our studio;

Advertising and analytics partners, including Meta, Google, and Pinterest, as described in Sections 2 and 5;

Legal and safety recipients, to comply with law, respond to legal process, and protect our rights and the safety of our customers and the public; and

Business transferees, in connection with a merger, acquisition, financing, or sale of assets.
We do not sell, rent, or disclose your personal information to third parties for their own direct marketing purposes without your consent. Information shared with advertising partners as described in Sections 2 and 5 is subject to those partners' own privacy policies.
5. “Sale” and “Sharing” of Personal Information; Targeted Advertising
Our use of advertising technologies such as the Meta Pixel and Google and Pinterest tags may be considered a “sale” or “sharing” of personal information, or processing for “targeted advertising,” under the California Consumer Privacy Act (as amended by the CPRA) and similar laws in Colorado, Connecticut, and Virginia. In the preceding twelve months, we may have sold or shared online identifiers, internet and network activity, and inferences for these purposes. We may have sold or shared these categories of information to the following categories of third parties: advertising networks (including Meta, Google, and Pinterest), analytics providers, and social media platforms. We do not knowingly sell or share the personal information of consumers under 16 years of age.
You can opt out of this activity at any time by adjusting your cookie settings, sending a Global Privacy Control signal, or contacting us as described in Section 8, or at this link.
6. Sensitive Personal Information
We collect account login credentials, which California law treats as sensitive personal information. We use this information only to authenticate your account, maintain security, and prevent fraud. These are among the purposes that are exempt from the right to limit the use of sensitive personal information under California law. We do not use or disclose your login credentials to infer characteristics about you or for any other purpose, so no separate limitation request is necessary. You may contact us with any questions at any time.

7. Profiling and Automated Decision-Making
We use tools, including Shopify apps and our advertising partners, to personalize content, product recommendations, and advertising. This profiling is used only for marketing and personalization. It does not produce legal or similarly significant effects, and we do not use it for decisions about credit, employment, or comparable matters. You can opt out of targeted advertising and profiling for marketing as described in Sections 5 and 8.
We collect account login credentials, which California law treats as sensitive personal information. Depending on the apps, features, and settings used on the Site, we may also collect other sensitive personal information, such as precise geolocation. We use sensitive personal information only for limited purposes, such as providing and securing your account, processing your orders, and operating the Site, and not to infer characteristics about you. You may request that we limit the use of your sensitive personal information by contacting us at info@tannerfletcherstudios.com or through the privacy controls available on the Site, and we will honor that request as required by law.
8. Your Privacy Rights (United States)
Depending on your state of residence, you may have the right to know or access the personal information we hold about you, to correct it, to delete it, to obtain a portable copy, to opt out of the sale or sharing of your personal information and of targeted advertising and certain profiling, and not to be discriminated against for exercising your rights. California residents also have the right to limit the use of sensitive personal information where applicable.
How to exercise your rights
Submit a request by emailing us at info@tannerfletcherstudios.com, or at https://tannerfletcherstudios.com/pages/data-sharing-opt-out . We will verify your identity as required by law before responding, generally within 45 days, and we may extend that period where permitted. You may use an authorized agent to submit a request on your behalf.
Right to appeal
If you are a resident of Colorado, Connecticut, or Virginia and we decline to act on your request, you may appeal by replying to our decision or contacting us at info@tannerfletcherstudios.com. We will respond to your appeal within 45 days (60 days for Connecticut residents), and we may extend that period by an additional 60 days where reasonably necessary, in which case we will notify you of the extension and the reason. If your appeal is denied, you may contact the Attorney General in your state: the Colorado Attorney General (coag.gov), the Connecticut Attorney General (portal.ct.gov/ag), or the Virginia Attorney General (oag.state.va.us).
Non-discrimination
We will not discriminate against you for exercising your privacy rights. We will not deny you goods or services, charge you a different price or rate, or provide a different level or quality of goods or services because you exercised your rights, except where any difference is reasonably related to the value provided by your data under a lawful financial incentive program, as described in the Financial Incentives section.
9. SMS / Text Message Marketing
We obtain your prior express written consent before sending marketing text messages, and consent is not a condition of any purchase. If you opt in to receive text messages from us through Klaviyo, you consent to receive recurring automated marketing and transactional messages at the number you provide. Message and data rates may apply, and message frequency varies. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages.

10. Email Marketing
If you subscribe to our emails, we will send you marketing messages about our products, promotions, and events through Klaviyo. You can unsubscribe at any time using the link in any marketing email. Unsubscribing from marketing does not affect transactional messages.
11. Financial Incentives
We offer programs that provide a benefit, such as a discount on your first order, a sign-up offer, or loyalty rewards, in exchange for your enrolling and providing certain personal information. Under California law, these are considered financial incentives.
When you take part in one of these programs, we collect personal information such as your name, email address, and phone number, along with information about your purchases and your engagement with us. We use this information to provide the benefit, administer the program, and send you related communications.
The value of the personal information you provide is reasonably related to the value of the offer or reward you receive. We have made a good-faith estimate of that value based on the cost of the discount or benefit provided to participants.
Participation is voluntary. You may enroll by signing up through the relevant offer or program, and you may withdraw at any time, without penalty, by unsubscribing through the link in any marketing message or by contacting us at info@tannerfletcherstudios.com. If you withdraw, you may no longer receive the related benefit.
12. Data Retention
We retain personal information for as long as needed to provide the Site and our services, to comply with our legal, tax, and accounting obligations, to resolve disputes, and to enforce our agreements. Retention periods vary by data type and typically range from the duration of your account or transaction plus applicable limitation periods, up to seven years for financial and tax records.
13. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. In the event of a data breach affecting your personal information, we will notify you in accordance with applicable law.
14. Children's Privacy
The Site is intended for adults. We do not direct the Site to, and we do not knowingly collect personal information from, anyone under 13. Consistent with Section 5, we also do not knowingly sell or share the personal information of any consumer under 16. If we learn that we have collected personal information from a child under 13, or that we have sold or shared the personal information of a consumer under 16 without the required opt-in, we will delete the information or stop the activity. Please contact us if you believe a child has provided us personal information.
15. Third-Party Links and Features
The Site may link to or embed content from third-party websites and platforms, including social media. We are not responsible for their privacy practices, and we encourage you to review their privacy policies.
16. Changes to This Policy
We may update this Policy from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Your continued use of the Site after an update means you accept the revised Policy.
